Terms and conditions

 

This contest is organized pursuant to Article 232 of the Law on Contracts and Torts - Case of contest by Društvo za marketing SmartPoint Adria  d.o.o., Murmanska 19, 11000 Belgrade, Serbia, registry number 20776650 (“SmartPoint Adria” or “Organiser”), with the authorization of TotalEnergies Marketing Serbia d.o.o. (TotalEnergies). To avoid any misunderstanding, the contest, as well as the Terms & Conditions, do not contain elements of prize-winning games of chance (in goods and services) and consequently the Law on Games of Chance shall not apply.

Terms of participation

To participate in this contest, you must fully read and accept our Terms & Conditions.

Employees/engaged persons of SmartPoint Adria and TotalEnergies, as well as their relatives up to 3rd degree, are not allowed to participate in this contest.

One participant can win the prize only once.

Only one family member residing at the same address can win the prize.

Only adult citizens of the Republic of Serbia can win the prize.

Reward mechanism

The contest lasts for 7 calendar days, from the 20th to the 26th of September.

To participate in the contest, it is necessary to follow @totalenergies_rs Instagram profile and provide correct answer to the quiz question within the Story post.
Every day within the above-mentioned period, first 10 participants who answer the given quiz question correctly, win the prize.

All prizes are of the same nature and consist of an AMClub card for activating a one-year Roadside Assistance membership package on the territory of Serbia. Package activation is done by calling the AMC Serbia contact center directly or through the application, following the information on the leaflet that will be enclosed in an envelope together with the card.

THE PACKAGE CONTAINS:

1 x towing up to 60 km (in case of a traffic accident)
1 x paid hotel accommodation
1 x legal advice
1 x passenger transport

 

Announcement of winners

The names of the prize winners will be announced each day as part of the Story post, for the quiz question from the previous day.
Winners are expected to establish contact via direct message to @totalenergies_rs within 3 calendar days from the day of their announcement, submitting the following information: name, surname, address and telephone number.

In case that there is no feedback from the winners within the designated period, the Organizer will contact the winners by direct message. If, in the second attempt, the Organizer does not receive the information necessary to delivery of the prize, it will be kept by the SmartPoint Adria agency and returned to TotalEnergies.

Collection of prizes

Delivery of prizes will be done by Post Express courier service on behalf of the winner, within 7 calendar days from the date when the winner sends the delivery details. Delivery costs will be covered on the territory of the Republic of Serbia.

In case there is more than one winner who provides the same delivery address (place of residence, street name and house number) only one prize will be delivered to the address provided.

If the courier service does not find the participant at the given address, the prize will be returned to the Organizer. In such case, the Organizer will send the prize once again within 7 calendar days from the date when the shipment was returned. If the prize is not claimed for the second time, as well as in the event that the receipt of the prize has been rejected, the prize will be returned to the Organizer irretrievably.

Prizes are not transferable to third party without the consent of the Organizer and TotalEnergies, and cannot be replaced for money.

Data usage

All personal data of participants is protected by TotalEnergies and SmartPoint Adria and will not be shared or published outside of TotalEnergies and SmartPoint Adria.
By participating in the contest, the participants are aware of and fully agree to provide personal data for collection/processing/usage purposes. The personal data will be used exclusively for access, usage and participation in the contest, identification, delivery of the prizes and receiving correspondence from the Organizer.
The participants confirm that they are at least 18 years old, have submitted accurate data (name, surname, address and telephone number), have read the Terms and Conditions and agree with them.

SmartPoint Adria and TotalEnergies are only responsible for content they produce and set up themselves.

The services included in the Roadside Assistance package are the responsibility of the AMC Serbia organization. SmartPoint Adria and TotalEnergies are not responsible for the implementation of services from the package.

SmartPoint Adria, TotalEnergies and any third party involved in the development and distribution of the contest do not accept any kind of responsibility for any damage, loss or malfunction that the participant may experience, including malicious software (viruses) as well as damage/loss/malfunction due to downloading any materials, content, data, texts, images, photographs, videos and audio materials from the totalenergies.rs website and @totalenergies_rs Instagram profile.

This contest cannot be used or shared in any kind of commercial purposes and is only available for personal usage and the above-mentioned purpose, in accordance with the Terms and Conditions.

Participants suspected of misusing in order to obtain prizes will be disqualified without prior notice or explanation. The Organizer is entitled to remove all text or claims that contain or represent discrimination, abusive content and offense on racial, religious or any other grounds, without any explanation.
The contest may be suspended or postponed in the event of objective reasons that could not be foreseen, prevented, eliminated or avoided, and which significantly affect the implementation and realization of the contest/campaign, for which the Organizer is not responsible.
